The office of President is effective immunity against everything other than "High Crimes and Misdemeanors" Congress can impeach for those (as this current congress has) only the Senate can remove an impeached President (as this current Senate has refused to do).Can a sitting president be charged with sedition? Or is he allowed to incite the crowds and encourage rebellion without any consequence?
But what happens if his "base" starts an uprising incited by his rhetoric? Nothing still? Essemtially there's no recourse to nip it in the bud so to speak? He has 70% republicans believing the democrats stole the election through fraud by messing with the ballots.....and they're mad.The office of President is effective immunity against everything other than "High Crimes and Misdemeanors" Congress can impeach for those (as this current congress has) only the Senate can remove an impeached President (as this current Senate has refused to do).
Once the office of President is no longer a shield it will be up to respective Prosecutors to determine whether or not any criminal charges will be laid.
I suspect that there will be a number of charges laid against Trump within hours of Biden taking the Oath of Office. Most will likely be related to matters prior to his Presidency. I do not expect his rantings while in office to result in any charges simply because Republicans have been loathe to contradict him for any reason. Ted Cruz who sat dumbly by while Trump insulted his wife's appearance and insinuated that his dad was in on the JFK assassination was willing to speak on his defence in the Supreme Court over the election steal lie.
Dems will be happy just to have Trump sidelined and out of the way.
You think this "movement" will quiet down after the election?I do wonder if indeed 70% of Republicans support this mess. I really hope it's an embarrassing lesson for them to brush off. I choose to believe much of that "support" was craven expedience and requisite grovelling. They can distance themselves any time after Jan 20th.
No.You think this "movement" will quiet down after the election?
It is hard to talk about what would normally happen in such an instance when Trump is an anomaly. But what happens if his "base" starts an uprising incited by his rhetoric? Nothing still? Good points.....I will breathe easier and I'm not even American. It is hard to talk about what would normally happen in such an instance when Trump is an anomaly.
That said, in most speech crimes (since the man isn't going to commit physical violence himself) the test will always be whether or nor reasonable people are swayed by his words or whether or not he believes what he is saying to be truthful.
Anybody who hasn't seen the man for the bald-faced liar he is doesn't qualify as reasonable and he isn't going to admit that he said something that has been videotaped several times over.
There are a few fringe elements that might be inspired to take further action without leaders actually willing to take up arms and lead them nothing large scale is going to happen. No politician has grabbed their gun to take back the country. No General has mobilized troops under their command to defend Trump's tenure because those are reasonable people who understand that there would be real-world consequences for such sedition. In short, those office holders without the immunity of the office of President are all talk and no action. And they talk the way they are because they fear what happens if they don't carry Trump's water.
The rest of the Trump supporters are not organized to be an effective national militia and while there may be individuals who aspire to be Generals for some Trump Army they are likely of such poor renown that they couldn't inspire anyone outside their immediate orbits. And with the plot against Whitmer having been uncovered you can bet that law enforcement on all levels is monitoring other militia groups very tightly.
I find Michael Flynn's recent words a bit concerning. He has lots of followers. It is hard to talk about what would normally happen in such an instance when Trump is an anomaly.
