The more seriously a society (or platform, or regime, or institution) wants to control outcomes through speech regulation, the less genuine free speech it can ultimately tolerate.

When it comes to free speech vs. control I am more inclined to tolerate riding in the "Lucer" lane than I am to tolerating those riding in the "control matters more" Carney lane.

That's they jab of it.

To be clear, the whole idea of eliminating religious belief as a defense for hate speech originated with the Bloc and their allies the CAQ with their whole "secularization" project (which seems peculiarly slanted against non-RC faiths). The Libs went along because it's a minority government. Not sure it would have been there absent that influence. It likely won't stand up in court anyhow. They can say it is not a defense in the law but the SCC gets final say on whether doing so is actually constitutional and if I was a lawyer specializing in charter cases, I would already be sharpening my arguments because there is no way this is not going to be challenged.

Premier François Legault has just announced his resignation as Quebec premier.
He will remain in office until the Coalition Avenir Québec (CAQ) selects a successor.
I saw that. Given what I've heard about the polls in the Quebec, sounds like the rat leaving the sinking ship before this year's election.

Might also apply to today's Federal Court of Appeal's unanimous decision:

(January 16, 2026) The Trudeau government's 2022 invocation of the Emergencies Act during the Freedom Convoy protests was unreasonable, not legally justified, and violated Charter rights — specifically freedoms of expression, association, and protection against unreasonable search and seizure (e.g., the bank account freezes without proper oversight).

Welp, no way that one's not headed for the Supremes, eh. Some lawyers Justice Department will be putting in for some overtime, I suspect.

The ball is in Carney's court - we'll see.

It is plausible that he will not call for appeal in hopes of letting it fade it into the background without much fuss.

I have not seen a public statement or direct response from Carney/Liberal government on the ruling yet.

Carney publicly supported tough measures like bank account freezes back in 2022.

He went as far as to call elements of the protest "seditious" in some commentary.

A government appeal to the Supreme Court would keep the issue alive longer.

It might be in the best interest of Carney to let this quietly slip away without a forced reckoning.

The "let it ride" strategy - IMO - could be the path of least resistance for the "new" Liberal government.

I think he's still in China or on the way home so might not have had a chance to talk to the relevant cabinet ministers and advisors yet. Letting it slide is feasible and deals with some potential PR problems continuing to fight it raises, but it also has an impact on how much room the government has to take action the next time a situation like that unfolds so a final ruling would be good for him to have so he knows for sure just what is allowed. Waiting until a crisis and then going to the Supremes would be even worse. At least doing it now with no crisis pending, he can frame it as clarifying the ruling for the next time rather than fighting it.

Legally speaking, the Supremes have the final word (no word on whether Diana Ross gets a say :ROFLMAO:). Yes, he could go the route of accepting the lower court rulings and PMs have done that before. OTOH, not having the SCC's imprimature means the door is not entirely closed to another go around. What if someone affected by a future "emergency" sues arguing the government didn't do enough to protect them? Sure, the appeals court ruling will help them in court but it could still end up at the SCC then. Why not close that door proactively?

To be clear, I am no fan of the convoy or the other protests involved and am a strong supporter of robust public health measures. But I also do think the government overstepped and am no fan of either the current act or its predecessor (the ominously named War Measures Act that Justin's father used in the FLQ situation in Quebec in the seventies).

It is a forced "unseen" ... blind something or other because of emotional options ...
 
Why not close that door proactively?
Government abuses emergency powers, disparages their own citizens instead of engaging with them, and then attempts to run out the clock through prolonged litigation - proactive door closing democracy at it's finest.
